1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Equanimity Hot Power Yoga & Barre ("Equanimity," "we," "us," or "our") website, and your booking or purchase of any classes, memberships, packages, or products through our website or booking platform.

By accessing our website, booking a class, or purchasing a membership or package, you agree to these Terms. If you do not agree, please do not use our website or services.

2. Booking & Scheduling

Class bookings, memberships, and account management are handled through Arketa, our third-party booking platform. By creating an account or booking a class, you agree to provide accurate and current information.

Class availability is not guaranteed until a booking is confirmed. We reserve the right to modify, cancel, or reschedule classes, substitute instructors, or adjust our schedule at any time, with as much advance notice as reasonably possible.

3. Cancellation & Late Policy

To cancel or change a class reservation, please do so at least CHANGE ME — 12 hours before the scheduled class time through your Arketa account. Cancellations made after this window, or missed classes without cancellation ("no-shows"), may result in the forfeiture of a class credit or a late cancellation fee, depending on your membership or package type.

We recommend arriving at least 10–15 minutes before class begins. Arriving late may affect your ability to join a class already in progress, at the instructor's discretion, for safety and to avoid disrupting other students.

4. Payments & Billing

All payments — including drop-in classes, class packages, memberships, and retail or gift card purchases — are processed securely through Stripe. By making a purchase, you authorize us (via Stripe) to charge your provided payment method for the applicable amount.

If you purchase a recurring membership, your payment method will be automatically charged on a recurring basis (e.g., monthly) until you cancel in accordance with our cancellation policy below. It is your responsibility to ensure your payment information stays current to avoid interruptions to your membership.

All sales are final unless otherwise stated. Class packages, memberships, and gift cards are non-transferable and non-refundable except where required by law or expressly stated at time of purchase.

5. Membership Cancellation

Recurring memberships may be cancelled at any time through your Arketa account or by contacting us directly, subject to any minimum commitment period disclosed at the time of purchase. Cancellation will take effect at the end of the current billing cycle; we do not provide partial refunds for unused time within a billing period.

6. Assumption of Risk & Liability Waiver

Please read this section carefully.

Yoga, barre, and other physical fitness activities involve inherent risks, including but not limited to the risk of physical injury. By participating in any class or activity at Equanimity, whether in-studio or via on-demand/virtual content, you acknowledge and voluntarily assume all risks associated with such participation.

You represent that you are physically fit and have no medical condition that would prevent your full participation, or that you have consulted a physician and received approval to participate. You agree to listen to your body, work within your own limits, and inform your instructor of any injuries, limitations, or pregnancy before class begins.

To the fullest extent permitted by law, you release and hold harmless Equanimity, its owners, instructors, employees, and affiliates from any and all claims, injuries, damages, or losses arising from or related to your participation in our classes or use of our facilities, except where caused by our gross negligence or willful misconduct.

7. Studio Conduct

We ask all students to treat instructors, staff, and fellow students with respect. We reserve the right to refuse service or entry, or to remove any individual from the premises, for behavior that is unsafe, disruptive, or disrespectful to others.

8. Website Use

You agree to use our website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site. You may not attempt to gain unauthorized access to any part of our website, booking system, or related systems.

9. Intellectual Property

All content on our website — including text, graphics, logos, and on-demand class videos — is the property of Equanimity or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.

10. Third-Party Services

Our booking and payment functionality relies on third-party services, including Arketa and Stripe. Your use of those services is also subject to their respective terms of service and privacy policies. We are not responsible for the availability, performance, or practices of these third-party services.

11. Limitation of Liability

To the fullest extent permitted by law, Equanimity shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or participation in our services, even if we have been advised of the possibility of such damages.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, policies, or legal requirements. The "Last Updated" date at the top of this page will reflect the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law principles.
